Terms of Service

These Terms of Service govern your use of the website of Tivaron Study and of every educational service we provide through it, including guided skills learning programs, interactive knowledge sessions, educational workbook and resource creation, and learning progress support. By browsing this website, submitting an enquiry through the guest book form, or engaging any of our services, you accept these Terms in full. If you do not accept them, please do not use the website or order our services.

1. Who we are and what we do

Tivaron Study is an online educational studio. Our work is preparing structured learning material and supporting people who study independently. We design step-by-step programs for acquiring new skills, prepare thematic learning modules, organise a sequenced study process, hold educational online sessions in individual and group formats, discuss practical examples and thematic tasks, accompany participants as they work through material, write workbooks, exercise sets and reference resources, help learners draw up personal study plans, advise on organising independent preparation, and prepare materials for review and self-assessment.

All services are educational and non-certified in nature. They do not include accredited instruction, degree programs, professional licensing, examination administration, or any regulated educational activity. Nothing we provide grants academic credit, a qualification, a diploma, a licence, or a professional credential of any kind. Where a learner needs an accredited or regulated program, they should approach an accredited institution or the appropriate licensing body directly.

2. Eligibility

Our services are intended for adults aged 18 and over. A person under 18 may take part only where a parent or legal guardian arranges the service, agrees to these Terms on the learner's behalf, and remains responsible for supervision and payment. By ordering a service you confirm that you have the legal capacity to enter into a binding agreement and that the information you provide about yourself is accurate and complete.

3. Enquiries, quotations and the formation of an agreement

The prices published on this website are indicative starting prices for standard scopes of work. They are an invitation to discuss, not a binding offer. A working agreement between you and Tivaron Study is formed only when we have confirmed, in writing, the scope of work, the deliverables, the schedule and the final fee, and when you have accepted that confirmation.

The guest book form on this website is an enquiry channel. Submitting it does not reserve a place in a session, commission a workbook, or oblige us to accept the work. We reserve the right to decline any enquiry, including where the requested subject falls outside our competence, where the request would involve regulated or accredited instruction, or where the intended use of the material appears to conflict with these Terms.

4. Scope of the services

4.1 Guided skills learning programs

A program is a written learning route: staged tasks, checkpoints, a reading order and a suggested schedule. It is delivered for self-paced study. The program describes what to study and in what order; it does not perform the study for you, and its value depends on the effort you put into the work it sets out.

4.2 Interactive knowledge sessions

Sessions are live, held online, individually or in a small group. They consist of guided discussion, analysis of worked examples, and the accompaniment of participants through material. Sessions are not lectures for credit, not tutoring toward a regulated examination, and not the administration of any test.

4.3 Educational workbook and resource creation

We prepare workbooks, practice sets, reference sheets and consolidation material on the topic you specify. Drafts are shared for review, and one round of revision within the agreed scope is included unless the written confirmation says otherwise. Substantial changes of topic, structure or length after work has begun are treated as a new scope and priced accordingly.

4.4 Learning progress support

Progress support consists of individual study plans, advice on organising independent preparation, and materials for reviewing and self-checking topics already studied. It is guidance on the organisation of study. It is not an assessment service, does not produce a grade, mark or transcript of any legal effect, and does not constitute a professional evaluation of ability.

5. Your responsibilities as a learner

  • Provide accurate information about your goals, prior knowledge and available time, so that the material we prepare is appropriate.
  • Attend booked sessions at the agreed time, or reschedule in accordance with clause 7.
  • Maintain a stable internet connection and a device suitable for online sessions; we cannot deliver a session over a connection that does not permit it.
  • Do the work. Programs, workbooks and plans describe a route; results depend on the study you actually carry out.
  • Use our material for your own learning only, in accordance with clause 8.
  • Treat our staff and other participants in group sessions with courtesy. We may end a session and terminate an agreement without refund where a participant is abusive, disruptive, or repeatedly obstructs the work of others.

6. Fees and payment

Fees are stated in United States dollars and exclude any taxes, duties or bank charges that may apply to your payment. Unless the written confirmation states otherwise, program fees, workbook fees and resource fees are payable in full before work begins; session fees are payable before the session is held; monthly progress support is payable in advance for each month. Work does not begin, and sessions are not held, until payment has been received.

Where a scope of work is extended at your request, the additional fee is agreed in writing before the additional work is carried out. We do not charge you for work you have not approved.

7. Rescheduling, cancellation and absence

A booked session may be rescheduled without charge if you notify us at least 24 hours before the agreed start time. A session cancelled or rescheduled with less than 24 hours' notice is treated as held and is charged in full. If a participant does not appear within 15 minutes of the start time and has not contacted us, the session is treated as held.

If Tivaron Study must postpone a session, we offer an alternative time at your convenience or, where no alternative is acceptable to you, a full refund of that session. Refund entitlements for programs and prepared materials are set out in our Refund Policy.

8. Intellectual property and permitted use

All programs, workbooks, exercise sets, reference sheets, plans, session materials, texts, diagrams, layouts and other works prepared by Tivaron Study, together with the design, structure and content of this website, remain our intellectual property. On payment in full you receive a personal, non-exclusive, non-transferable licence to use the delivered material for your own study.

Unless we agree otherwise in writing, you may not resell, sublicense, publish, distribute, upload to a public or shared repository, use for commercial teaching, or otherwise make available to third parties any material we prepare, in whole or in part, whether in the original form or in a modified or derivative form. You may not remove attribution from our material. Where material has been commissioned for use inside an organisation, the permitted circle of users is defined in the written confirmation and nowhere else.

9. No professional, academic or regulated advice

Our material is educational. It is not legal, financial, medical, psychological, tax, immigration or other professional advice, and it must not be relied on as such. It does not prepare a person for licensure and does not substitute for accredited study where accredited study is required. Decisions you take on the basis of material studied with us remain your decisions, taken at your own risk and, where appropriate, on the advice of a qualified professional in the relevant field.

10. No guarantee of outcome

We take care with the design and preparation of everything we deliver, and we stand behind the quality of the material. We do not and cannot guarantee any particular learning outcome, examination result, admission, promotion, employment, income or other benefit. Learning outcomes depend on factors outside our control, including the time, effort, prior knowledge and circumstances of the learner. Any example of progress described on this website is illustrative and is not a promise of a comparable result.

11. Availability of the website

We aim to keep this website available and accurate, but we do not warrant uninterrupted or error-free access. The website may be suspended for maintenance, updated, restructured or withdrawn without notice. Content on the website may be revised at any time, including prices, which apply as published at the moment a scope of work is confirmed in writing.

12. Limitation of liability

To the fullest extent permitted by applicable law, Tivaron Study is not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profit, opportunity, data, goodwill or anticipated savings, arising out of or connected with the use of this website or of our services. Our total aggregate liability in connection with any service is limited to the amount you actually paid for that service. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify and hold Tivaron Study harmless against any claim, demand, loss or expense arising from your breach of these Terms, from your misuse of material we prepared, or from your infringement of the rights of a third party in connection with our services.

14. Suspension and termination

We may suspend or terminate an agreement, without refund of work already performed, where a learner breaches these Terms, distributes our material without permission, behaves abusively toward our staff or other participants, or provides materially false information in order to obtain a service. You may end an ongoing engagement at any time by writing to us; the effect on fees already paid is governed by our Refund Policy.

15. Changes to these Terms

We may amend these Terms from time to time. The version published on this page at the moment your scope of work is confirmed is the version that governs that engagement. Continued use of the website after an amendment constitutes acceptance of the amended Terms for future engagements.

16. Governing law

These Terms and any dispute arising from them are governed by the laws of the State of Arkansas, United States, without regard to conflict-of-law principles. The parties will attempt in good faith to resolve any dispute by correspondence before pursuing any other remedy, and the courts competent for Benton County, Arkansas, have jurisdiction over any dispute that cannot be resolved that way.

17. Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, Educational Disclaimer and the written confirmation of your scope of work, constitute the entire agreement between you and Tivaron Study in respect of the services. If a provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
